1. Scope and acceptance

These Terms of Service (“Terms”) govern your use of the Mindful Pause iOS app (the “App”), provided by [full name / company name], [address] (“we,” “us”). By downloading or using the App you agree to these Terms. Apple’s own terms (including the Apple Media Services Terms and Conditions) apply to your purchase and download of the App through the App Store.

2. The App

Mindful Pause offers guided mindfulness pauses, reflection tools, audio lessons, streak tracking, and optional AI-supported features. The App requires no user account. Some features are free; others are part of the paid Premium subscription described in section 4.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, for your personal, non-commercial use, in accordance with these Terms and Apple’s usage rules.

4. Premium subscription

  • Premium is offered as an auto-renewing subscription with a monthly or a yearly term, purchased as an Apple in-app purchase and billed to your Apple account.
  • The current prices are shown in the App and in the App Store before you purchase.
  • The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period; renewal is charged within 24 hours before the period ends.
  • You manage and cancel your subscription in your Apple account settings (Settings → your name → Subscriptions). Deleting the App does not cancel a subscription.
  • Payments, renewals, and refunds are handled by Apple under Apple’s terms; refund requests are made to Apple at reportaproblem.apple.com.
  • If a statutory right of withdrawal applies to your purchase, it is exercised through Apple as the seller of record.

5. AI-generated content

Premium features use OpenAI’s API to generate explanations, reflection questions, and progress reviews. AI-generated content can be inaccurate, incomplete, or unsuitable for your situation. It is offered as an aid to reflection only — it is not medical, psychological, legal, or other professional advice, and you should not rely on it as such.

6. Health disclaimer

The App supports general well-being and mindfulness practice. It is not a medical device and not a substitute for professional medical or psychotherapeutic diagnosis or treatment. Never disregard or delay professional advice because of something in the App. If you are in crisis or think you may harm yourself, contact your local emergency services immediately.

7. Intellectual property

The App and its contents — including texts, exercises, audio lessons, design, and software — are protected by copyright and other intellectual property rights and remain our property or that of our licensors. You may not copy, distribute, publicly perform, or create derivative works from App content outside the App, except as permitted by mandatory law.

8. Acceptable use

You agree not to misuse the App — in particular, not to reverse engineer it (except where mandatory law permits), not to circumvent technical restrictions or the subscription mechanism, and not to use the App in any unlawful way.

9. Warranty and liability

The App is provided with the care appropriate for a free-to-download consumer app with optional paid features. To the extent permitted by law, we are not liable for damages arising from slight negligence, except for damages resulting from injury to life, body, or health, from the breach of essential contractual obligations (in which case liability is limited to the foreseeable damage typical for this kind of contract), or where liability is mandatory by statute (e.g. product liability law). We do not guarantee uninterrupted availability of features that depend on third-party services (such as AI features or the App Store).

10. Changes to the App and to these Terms

We may change, add, or remove features of the App, and we may update these Terms for good reason — for example when features, legal requirements, or third-party services change. The current version is always available on this page. Material changes to paid features will be communicated in the App or via the App Store where required.

11. Governing law

These Terms are governed by the laws of [Germany — confirm jurisdiction], excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country in which you habitually reside remain unaffected.
